A fix is in main. It will probably need to be backported, so leaving this open for now so the release branches aren't blocked until backport PRs are made.

I think we just got hit by this in servicing branches. Since fix is test-only I'm marking this as test-bug but we should backport #117734

Hmm there is #117762 but looking at https://github.com/dotnet/runtime/blob/release/8.0/src/libraries/System.Security.Cryptography/tests/X509Certificates/ChainTests.cs#L363 it seems to be missing the fix - is staging branch not flowing into release/8.0?

This issue has been fixed; back ports have been merged and flowed in to the appropriate release branches. This hasn't occurred in a while, so I think we are good to close this out.
