A live region is only output if it already exists in the DOM and then within the live region the content changes. Your example cannot work because the live region is inserted dynamically. At the same time the content is inserted. So there is no live region at the time the button is activated and therefore no change in the live region can be output by the screen reader (JAWS and NVDA). In my opinion, this is not an error of JAWS.
